Terms of Service

These Terms of Service (“Agreement”) are a legally binding agreement between Paragon Care, LLC (“Clinic,” “we,” “us,” or “our”) and you (“Patient,” “you,” or “your”) governing your use of our website, services, and interactions with our clinic.

By accessing our website, scheduling an appointment, or receiving services, you agree to be bound by these Terms. If you do not agree, you should not use our services.

 

1. Services Provided

Paragon Care provides outpatient physical therapy services, including but not limited to:

  • Physical therapy evaluations and treatments

  • Rehabilitation services

  • Wellness and performance services

  • Administrative and scheduling support

All services are provided in accordance with applicable laws and professional standards.

 

2. Eligibility

By using our services, you represent that:

  • You are at least 18 years old, or

  • You are a parent/legal guardian consenting on behalf of a minor

  • You are legally able to enter into this Agreement

 

3. Medical Disclaimer

Our services are not a substitute for emergency medical care.

  • If you are experiencing a medical emergency, call 911 immediately

  • Physical therapy services are based on clinical judgment and patient participation

  • Outcomes are not guaranteed

 

4. Appointments and Cancellations

  • Patients are responsible for attending scheduled appointments

  • We require at least [24 hours] notice for cancellations or rescheduling

  • Missed appointments or late cancellations may result in a no-show fee

We reserve the right to reschedule or cancel appointments when necessary.

 

5. Payment Terms

  • Payment is due at the time of service unless otherwise agreed

  • We may accept insurance, but coverage is not guaranteed

  • Patients are responsible for:

    • Co-pays

    • Deductibles

    • Non-covered services

Failure to pay may result in:

  • Suspension of services

  • Referral to collections

 

6. Insurance and Billing

If insurance is used:

  • You authorize us to bill your insurance provider

  • You agree to provide accurate and complete insurance information

  • You are responsible for any remaining balance

We are not responsible for insurance claim denials.

 

7. Patient Responsibilities

You agree to:

  • Provide accurate health and personal information

  • Follow treatment plans and therapist instructions

  • Treat staff and other patients respectfully

  • Comply with clinic policies and safety procedures

Failure to comply may result in termination of services.

 

8. Privacy and HIPAA Compliance

Your use of our services is also governed by our:

  • Privacy Policy

  • Notice of Privacy Practices (HIPAA)

We are committed to protecting your Protected Health Information (PHI) in accordance with applicable laws.

 

9. Website Use

When using our website, you agree not to:

  • Use the site for unlawful purposes

  • Attempt to gain unauthorized access

  • Interfere with site functionality

All content on our website is owned by Paragon Care and may not be copied or reused without permission.

 

10. Intellectual Property

All materials, including:

  • Logos

  • Branding

  • Content

  • Documentation

are the property of Paragon Care and protected by intellectual property laws.

 

11. Limitation of Liability

To the fullest extent permitted by law:

  • We are not liable for indirect, incidental, or consequential damages

  • Our total liability is limited to the amount paid for services

This includes, but is not limited to:

  • Treatment outcomes

  • Delays or interruptions in service

 

12. Indemnification

You agree to indemnify and hold harmless (Paragon Care) from any claims arising from:

  • Your misuse of services

  • Failure to follow medical advice

  • Violation of this Agreement

 

13. Termination of Services

We may terminate or refuse services if:

  • There is non-payment

  • Disruptive or unsafe behavior occurs

  • Policies are repeatedly violated

You may discontinue services at any time, subject to payment obligations.

 

14. Governing Law

This Agreement is governed by the laws of the State of Texas, without regard to conflict of law principles.

 

15. Dispute Resolution

  • Parties agree to attempt to resolve disputes informally first

  • Any legal action must be brought in courts located in Dallas County

 

16. Changes to Terms

We may update these Terms from time to time.

  • Updates will be posted on our website

  • Continued use of services constitutes acceptance of changes
